Equal Pay

Employees have an implied right in their contracts of employment that they will receive equal treatment to comparable workers of the opposite sex, in appropriate circumstances.

The Equal Pay Act 1970 provides that this will arise where:

• The comparator is engaged in Like Work

• The comparator is engaged in Work Rated as Equivalent

• The comparator is engaged in Work of Equal Value

The employer has available the defence of genuine material difference. This can include commercial reasons such as differences in qualifications, the market at the date of recruitment.
