Constructive Dismissal - occurs where an employer acts in such a way as to breach the contract of employment with the employee and leave them no alternative but to resign.
Contractual Notice - the notice period required from either employer or employee in order to terminate employment, as set out in the contract of employment. In some cases, this can be implied, on the basis of notice periods that apply to others.
Statutory Minimum Notice - the minimum notice that applies. It is based on completed years of service. After 1 month it is one week from either party. Where an employee has 2 or more years service the amount required from the employer increases by 1 week per complete year of service to a maximum of 12 weeks after 12 years' service. This will override any lower contractual notice period.
