Deductions From Wages

If an employee or worker is denied a payment they are entitled to receive, they can claim to have suffered an unlawful deduction from wages.

These claims can be brought whilst the employee or worker is still employed. A claim can be in respect of one failure or a continuous chain (for example a shortfall of salary each month).

There is no cap on the amount that can be claimed in this way.

In order to make a deduction lawfully, an employer will need to demonstrate that that they had consent, or the contractual right, to make such a deduction. It is therefore necessary to consider whether such authority exists before a claim is pursued.
